Torrens System
New Zealand's land registration system where the government guarantees the accuracy of the title register, meaning the person on the title is the legal owner.
What is a Torrens System?
The Torrens system is the land registration system used in New Zealand (and Australia, where it was invented by Sir Robert Torrens in 1858). Its key principle is 'indefeasibility of title' โ the government guarantees that the person registered on the certificate of title is the true legal owner of the property.
This is different from older 'deeds' systems (still used in some countries) where ownership is proved by tracing a chain of historical documents. Under the Torrens system, you don't need to trace the history โ the register itself is the proof. This makes buying and selling property faster, cheaper, and more certain.
New Zealand's Torrens system is governed by the Land Transfer Act 2017 and administered by Land Information New Zealand (LINZ). The system provides a government-backed compensation scheme if you suffer loss due to an error in the register.
Why It Matters for Due Diligence
The Torrens system gives buyers confidence that the title is accurate and government-guaranteed. However, the guarantee only covers what's on the register โ it doesn't protect you from physical issues with the property, unregistered interests, or problems that a LIM report or building inspection would reveal.
Always conduct full due diligence beyond the title search. The Torrens system guarantees ownership, but it doesn't guarantee the property is in good condition or free from all encumbrances.
How to Check
All New Zealand property titles are maintained under the Torrens system through LINZ's Landonline platform. Your lawyer accesses this system as part of the conveyancing process. You can also search titles yourself through the LINZ website.
Frequently Asked Questions
What does 'indefeasibility of title' mean?
It means the government guarantees that the person shown on the certificate of title is the legal owner. This can only be overturned in very limited circumstances, such as fraud by the registered owner. It gives buyers certainty that the seller actually owns what they're selling.
What if there's an error on the title?
LINZ can correct errors on the register. If you suffer financial loss due to an error in the register, you may be eligible for compensation from the Crown under the Land Transfer Act 2017. Your lawyer can advise on the process.
